Question

I'm filling as a dual-status alien therefore I cannot e-file my federal and state taxes. However, New York state doesn't allow mail filling. What can I do?

Is there any exception for dual-status aliens and we can file the state taxes by email? Do I need to add the residency termination statement to NY state taxes too apart from IRS?

You cannot e-file a state tax return if the federal return was not e-filed.  

  • New York only requires the state return to be e-filed if your software allows e-filing.  
  • Since the software will not let you e-file the state return then you're allowed to print and mail the New York state income tax return. Source: DoninGA

And how about sending the residency termination statement to the state taxes? Is that also needed or just sending it to IRS is enough?

I would suggest you to include that to your state tax return, just to be safe.
