he owes unemployment  money been filling together with  injured  spouse can I do my taxes separately and  not claim my kids

    You don't have to claim your children as dependents if you don't want to. If you do though then your child that is filing a tax return will need to indicate on their return that they are being claimed by someone else so that it is not rejected by the IRS. This information is asked in the personal information section at the beginning of the return.
