I maintain an apt in NY since I work there but also have a house in Virginia where we stay 1 week/month. Should I add Virginia as another state where I live?

Yes.  There are two types of Virginia residents, domiciliary and actual.  A domiciliary resident of another state may also be an actual resident of Virginia.

 

  • Domiciliary resident: The taxpayer is a domiciliary (legal) resident if his or her permanent home in Virginia. The permanent home is where, whenever absent, the taxpayer intends to return. Every person has one, and only one, domiciliary residence at a time. If the taxpayer has established legal domicile in Virginia, he or she is a domiciliary resident until establishing legal domicile in another state.
  • Actual resident: The taxpayer is an actual resident if the taxpayer maintained an abode in Virginia or was physically present in Virginia for more than 183 total days during the taxable year, even if domiciled in another state or country.
