Question

I receive respite pay for my niece who does not live with us. I just received a W-2, but i had been told i do not need to count it as taxable income. Is that true?

If you received a W-2 for respite pay that you did not receive or you did receive the respite pay and returned the funds, you need to contact the payer and have them issue you a corrected W-2.

If you did receive the respite pay and your niece did not live with you and you did not return the payments you will need to include the W-2 income on your return as taxable income. Respite payments are considered taxable income.
