I received 2 W-2s from the company with the same EIN, it shows I was over charged social security taxes, can I get a refund from my employer?

I was transitioned from one business unit to another but same EIN, does the social security max apply?

If the total SS taxes withheld from the two W-2's is over $8,853.60 then the employer has to refund you the excess taxes withheld.

are you sure you didn't work for 2 different companies (subsidiaries of a parent company) that use a common paymaster? that would be the reason the name and EIN is the same on both.
