Question

I received a 1099-MISC for wages my job didn't originally tax. I keep being led to self employed questions because I answer "yes, it involved an intent to earn money".

I'm confused how to get around this without showing up as self employed income. Anyone have any suggestions? Thank you.

if this is compensation that your employer omitted from your w-2, then you need to contact your employer to issue a corrected w-2. if you use the 1099-MISC you'll be responsible for the FICA and Medicare taxes.   if your employer refuses, you'll need to file form 4852 with your return to report the correct amounts. The IRS will contact the employer.

Thank you Mike9241. I should have mentioned the amount I earned is in box #3. Does that make a difference with the taxes?

Box 3 on the 1099-MISC is for income not related to employment. For employment income, you and your employer generally split the FICA taxes (SS and Medicare), and if you are self-employed, then you are responsible for all the FICA taxes.

 

Based on your description that this was for wages left off your W-2, then Mike's suggestion to get a corrected W-2 sounds correct. 

 

So long as you answer Yes to "yes, it involved an intent to earn money", you will be expected to file this as self-employed income and pay the self-employment taxes (FICA). And based on your description, this would be correct.
