Question

I received a w2 and 1099-misc for same amount from same settlement fund. I assume I have to put both as income correct? it almost seems like double income?

No, you do not have to report both. If the W-2 has boxes 3, 4,  5, and 6 completed, use the W-2.  It is accurately reporting that the settlement was for wages.
