We have not lived together since November 9th, 2016. I filed for separation in North Carolina where he is stationed  (he's in the military). He never signed the separation agreement. I moved back to Ohio (where we are both from) December 8th, 2016. He served me with Ohio divorce papers December 23rd,  2016. We have our final court date tomorrow. His lawyer advised us to file our taxes tomorrow once  we are divorced, and to file as single. Is this what I should do?

Your lawyer doesn't know what he's talking about.

Your status is determined on the last day of the year.

Ir, On December 31, 2016, you were "married" then that's your status for tax purposes for your 2016 return.

You choices are Married Filing Jointly, or Married Filing Separately.
