I would like to efile my NY state return before my federal return

An accountant is preparing my federal return and he will efile it himself. I have prepared my NY state return and I want to efile it. So in turbotax I select the option to not efile my federal and to efile my state return. It then tells me that the the state cannot be efiled until turbotax efiles the federal.

I am willing to simply mail the state return but turbotax says that NY state law requires that it be efiled if it was prepared using tax software.

Is there a way for me to just file the state return?

You will have to mail it.  As a security precaution, you can't e-file a state return unless you do it at the same time or after e-filing the federal return.  NY requires users of tax software to e-file "unless there is a situation that prevents it."  This would be such a situation.

However, why aren't you having the accountant file the state return as well?  Make sure the information in your federal return matches exactly between what you put in Turbotax and what your accountant prepares.  If the state return you file doesn't match the federal return filed by the accountant, you will get a letter and possibly a tax bill from NY.
