If I claim my fiance as a dependent on my taxes and he had a case with ORS, will they take my return?

If he files his own taxes they garnish the whole thing because he is behind on payments. But can they garnish mine to? We are not married but I did take care of him the last two years.

for you to claim him as a dependent since he is not your qualifying child the rules for qualifying relative must be met. they are that he: 

  • lived in the same household as you for all of 2022. Absences for medical treatment are ignored
  • had gross income for 2022 of less than $4,400
  • you provide over ½ his support
  • isn’t a qualifying child of another taxpayer

note:  even if you can claim him, you do not report his income. for him to get his withholding back he has to file his own return so if there's an offset in effect, his withholding will again be seized. yours is safe.
