If my previous employer put married instead of single on my w-2 and I was never married can I still file or do I need to have then change that ?

Your filing status is not really on your W-2.  There may be a notation on the paper the W-2 is attached to that indicates the employer withheld at the rate for married instead of single, but you just file your tax return with the correct filing status.  The amount the employer withheld will affect your tax due or refund, so going forward you can adjust it if necessary by filling out a new W-4 at work.

The filing status on your form W-4 is only used to determine how much tax will be withheld from your pay during the year. It does not affect the filing status on your tax return or the eligibility to file. You can file your tax return and you do not need to get your W-2 form corrected.
