Which state?

In general, if there is a filing requirement, you cannot choose not to file to avoid paying taxes.  For some states there is a filing threshold, while others have none.  If he is over the filing threshold or if your state does not have one, then yes, he will have to file a state return.

If he only made $1,402, then you may want to double check the entries in the state area of the W-2 section to be sure the numbers entered are correct.
