If my spouse did not work 2023 and does not have a w2 and does not plan to file 2023 do i still need to file jointly

You can file a joint return even if one spouse had little or no income.

 

 When you file a joint return, you and your spouse will get the married filing jointly standard deduction of $27,700 (+$1500 for each spouse 65 or older)  You are eligible for more credits including education credits, earned income credit, child and dependent care credit, and a larger income limit to receive the child tax credit.

No.  You can file jointly or separately.  However, if you only have your income, you will probably make out better if you file a joint return as the Standard  Deduction for married filing separately is $13,850 or married couples filing jointly is $27,700. This means twice the amount of income in excluded from taxation.  Plus, when you file separately, you are not eligible for as many credits as you are when you file a joint return.
