In process of divorce ok to take standard deduction or do i need to ask soon to be ex what option he is using?

If you and your spouse file separate returns and one of you itemizes deductions, the other spouse must also itemize, because in this case, the standard deduction amount is zero for the non-itemizing spouse.

If you are filing married filing separately you both have to file the same way---so put aside some of the "stuff" for long enough to agree whether you are both itemizing or both using standard deduction.   If you are itemizing--it will be trickier because you will need to agree on who itemizes what.
