In regards to an audit from NY State

Hello, my name is Arbine. I have filed an amended return for 2021 and 2022, and the IRS has recently processed it on March 18 and 20. I have gotten an audit letter back in January from NYS Department of Taxation and Finance stating that FAGI was a different amount then whatever was reported on my New York State return and was asking to pay back a big amount however, at that time my amended returns were not processed, and I have called the IRS they said that I will get a refund in 4-6 weeks even though my amended return on the website hasn't been processed. My bill for New York State of Taxation has been under review and I have been updating them on any new information. While I don't owe anything to the IRS, the state has a different opinion. What should I do in this matter because I believe the information is not correct and they are asking for a federal transcript. I do have a tax advocate who is helping me to speed up the proceedings from the IRS. Thank you!

    When you amended your federal return, did you also amend your New York returns?  You should send them copies of your Forms 1040X and the transcripts of the returns once they get processed.

    Yes, it was amended. Recently, I have gotten a CP21B letter stating about a refund and the summary showed a decrease in taxes. I wanted to know if this will have any effect on my audit letter from NYS as I checked today, and the bill didn't increase but stayed the same. I wanted to know if I need to send my account transcript or any form of document to ensure everything runs smoothly. About 1-2 weeks ago I got a notice of deficiency letter from NYS state of tax department however at that my tax return was not being processed yet. A few days later my account got adjusted and it was talking about a refund in 2-3 weeks. I wanted to know the best action to take at this moment. and if I need to send any documents or transcripts. Thank you in advance.

    It appears NYS is satisfied with the return and you do not need to take action on your part. You may wish, however, to contact NYS to see if you need to submit additional documents.  Other than that, it sounds like you do not have any additional filing requirements.
