So I have a question I am married and my husband is a 100 percent handicap disabled american retired Veteren he is not required to file taxes he receives almost $5000 each first of the month from the veterens administration well he owes $10,989.00 to child support well I usually file married filling separately for some reason the Jackson Hewitt lady filed mine the 27 of Jan 2025 as married filling joint and I was just notified that my entire refund that is $10204.00 was taken for his child support BS what can I do I filed the injured spouse today which is Feb 6 2025 will I get it all back since he doesn't work amd doesn't file taxes this is so unfair this child is not mine it's his from his ex any help is appreciated

Possibly, however, it depends on how you filled out the forms. If you showed the allocation as all income and refund was yours and none of it was allocated to him, then it is possible that you would get it all back. 

 

 If you live in a community property state, then his debt is considered to be your debt so you would not likely get it all back, but it depends on the rules of your state. 

 

It can take 8 weeks or longer for them to process your injured spouse form.
