Question

IRS From 709

I gifts each of my children $30,000 in mutual funds in 2023. My wife gifted nothing in 2023.

I believe I am required to file IRS form 709 so that my wife can officially consent to having 1/2 of the gifts to be considered to be by her for tax purposes. The form has many sections which I do not believe I need  to fill out since we have the $17,000 gift exclusion for 2023. Am I correct, or alternatively how should I fill out the 709 form?

If the funds are community property and so from both of you no 709 is required. If only from your separate property you do file the form but not as a split gift so only you complete the form.
