I was a J1 student from October 2022 to October 2023, and I have already returned to my home country. I filed taxes using TurboTax for the years 2021-2022 and 2022-2023, unaware that it's not suitable for non-residents. I would like to seek assistance on how to rectify this to avoid future issues with the IRS. Can I still fix this, and how long might it take to resolve?

My suggestion is to amend your 2022 and 2023 tax returns and change your choice of deduction from standard to itemized deductions. According the IRS, you can claim the following as itemized deductions. In your case, bullet point #1 may pertain to you if you live in a state that has state income taxes or in a local area that charges income tax just to be a resident in their jurisdiction.

 

  • State and local income taxes,
  • Charitable contributions to U.S. non-profit organizations,
  • Casualty and theft losses, from a federally declared disaster, and 
  • Other itemized deductions.

When you prepare your amendment, the reason that will give is that you filed a resident return when you should have prepared  non-resident return. You were not eligible for the standard deduction. You may owe taxes because of this mistake but this will correct the wrongs that may have  been omitted.  Here is how to begin the amendment process.

 

To amend your return using Turbo Tax Online.
 

  1. Log into Turbo Tax
  2. Select Scroll down Your tax returns & documents in your landing page.
  3. Select Amend (change) 2023 return. There should be a choice there to amend your 2022 return also.

Note: If you have already prepared and sent in your 2023 return, you will not be able to amend this return until 2/14. If you have not prepared it, do not prepare this in Turbo Tax. You will need to prepare a 1040 NR and Turbo Tax does not prepare these returns. Our affiliate at sprint tax does and you will need to contact them to prepare your return.
