Are there stipulations or any problem with filing "married filing separate" if you have filed jointly previously and are still married?

No, you can make the determination between married filing jointly and married filing separately each tax year.

However, in any given tax year, if you file separately, you can always amend to a joint return.  If you file jointly, you cannot amend to separate returns.  This only applies if you want to amend/correct an originally filed return.
