Question

Married filing separately with community property state and noncommunity property state

I live in TX and earn income whereas my husband lives in PA and earns his income there. My husband cannot file his taxes jointly and hence we are filing under Married Filing Separately. Now the tricky part is, TX is a community property state whereas PA is not. Should I adjust for community property in my taxes? Should my husband also do the same when filing his taxes?

Thanks.

You need to adjust your income to comply with community property rules, but you husband does not, as he does not live in a community property state.
