Your filing status is a personal choice as well as what's legal per tax law. You didn't state why you owe $3,400. Did the IRS not allow you to file as Head of Household (HOH) because your spouse filed as HOH?

If you're not separated, you may file Married Filing Jointly or Married Filing Separately.

If you're still married, you can't file Single.

To see if you meet the requirements to file as HOH, see Can a married person claim Head of Household filing status?
