MFS TP/SP Take Itm Ded should not be checked if filing status is not Married, filing separate. will not let me uncheck options under the married section

single is selected, and not married - but the options under married are selected and cannot be unselected: 

If both you and your spouse itemized deductions on your federal tax return:
Both you and your spouse will itemize deductions on your New York State tax returns
Both you and your spouse will take the New York standard deduction

Please clarify your question.  What status are you filing as?  Married Filing Separately or Single?

 

If you and your spouse file separate returns and one of you itemizes deductions, the other spouse can't use the standard deduction and should also itemize deductions.

 

New York State requires that you use the same filing status that you used on your federal return.

 

If you are filing as single you can chose to itemize or take the standard deduction whichever is most favorable for you.

 

If you have selected single and you have some options checked that should not be checked you may want to start over.

 

If you are using TurboTax Online you can do this as follows:

 

  1. Sign in to TurboTax and open or continue your return, if you haven’t already.
  2. Select Tax Tools from the left menu, then Clear & Start Over.
  3. Answer Yes to confirm.

 

If you started your tax return in TurboTax Free Edition (for simple returns only; not all taxpayers are eligible), you won't need to clear and start over. You can select Switch to Free Edition instead. Remember, you’ll need to upgrade before you file if you have info that isn’t covered in a simple tax return.
