My dad moved in with me and my husband and he still works. He files his own return and doesn’t pay us any money. Will the irs allow us to file separately.

Yes, there can be two returns from one address.  You and your husband will file as MFJ (Married Filing Jointly), and your father will file as Single.

 

This will be fine with the IRS and not raise any questions.
