My ex-wife claimed our daughter this year behind my back, it was my year to claim her, what should I do?

You won't be able to e-file if your ex-wife claimed your daughter on her taxes. You will have to mail in a paper tax return. Be prepared to show proof that you had the right to claim the dependents.

 

If your ex-wife is not willing to amend her income tax return to remove your daughter as her dependent, the IRS will eventually contact both of you to figure out who gets to claim her.  The losing party will then be liable for any additional taxes, penalties, and/or interest as a result of the false claim.
