My father claimed me as a dependent because I lived at home for 7 months last year but I got married and want to file jointly. Can I file jointly while also being claimed

    Since you've been claimed as a dependent, you can only file jointly if neither you nor your spouse are required to file a return and are only filing to get a refund of tax withholding. Otherwise, your father would need to amend his return to remove you as a dependent.

    Were you a college student in 2024?  Is your father claiming you in order to get education credit---or earned income credit---Head of Household filing status?   Or just claiming you out of habit?   

     

    Your situation is a tricky one.   If you file a joint return with your spouse you cannot be claimed as anyone else's dependent unless you have such low incomes that you are only filing jointly in order to seek refunds of amounts withheld from your paychecks.   

     

    If Dad claims you, it might mean you and your spouse have to file married filing separately--- and on your own return you would have to say you can be claimed as a dependent.  Filing MFS means neither you nor your spouse is eligible for education credit or earned income credit.   If you are in a community property state it gets even more complicated.

     

    You need to have a careful conversation with your dad to see which filing situation is better for all concerned.

     

    And....we do not even know if you and your spouse have children....which would further complicate it all.

    He claimed me out of habit and this would be the last year.


    I started back in college after I got married which was in early Aug. So the only time I was a "dependent" was when I was working semi part time. 

     

    My wife and I would make under the 30,000 between the both of us... We have 1099 and W2s. Would this mean we are simply only filing for a refund and not a return? 

     

    If I file as married jointly... but list that I was claimed as a dependent would the IRS send a notice to either one of us for who has to amend their taxes? I just wanna make sure I am filing correctly.

     

    We don't have kids nor do we live in a taxable community
