Question

My husband did work for a company out of GA, work was in TX, we live in KS. We got a 1099-NEC for less than $1000 for that work. Does this count as work in GA, KS, or TX?

He has a normal W-2 job, but was helping out his brother's company on a marketing job.

This is considered TX source Income. When you live in one state and work in another, the state where you work usually gets to tax you. Usually you have to file a non-resident return for the state where you worked to report the income earned in that state and you will claim a credit for the taxes payed to another state on your resident return.

However, since the job was done in TX and TX does not have income tax, your husband's 1099-NEC will be taxed on his Resident state return and it is the only state return that he needs to file.
