Question

My husband received a w2 for long term disability. He paid the premiums entirely thru his employer. Do I count this income as wages ?

There is no payment of ssa tax or medicare tax.  In box 12 there is an amount that is excluded from wages.  I don't know if the premiums were pretaxed and don't know how to find out.  My husband recently died.  Thanks for your help.

    I have one more question.  Even if there is income reported in box 1, the income is still non taxable ?

    If the Form W-2 was issued by his employer or its agent, the sick pay is taxable income, and the amounts in Box 1 must be reported. If the W-2 was issued by a third party, such as an insurance company to which your husband paid premiums through payroll deductions, the sick pay should be nontaxable, and Box 1 should be blank.

    My best advice is to speak to your employer's benefits representative to determine the correct treatment and, if necessary, have a corrected Form W-2 issued.

    I'm very sorry for your loss.

    The amount in Box 12 is Non-taxable sick pay (premiums were paid post-tax).
