My landlord refused to fill out a W9, so I can't issue a 1099-MISC. What can I do to avoid penalties for myself?

My landlord stated they had never heard of this and won't give me personal info. I lost money on my business last year (couldn't work during COVID, had to pay rent anyway) and don't want to be penalized if I am audited.

Create a Form 1099-MISC,  reporting all payments to your landlord. Process and submit to the IRS, and give a copy to your landlord.  You will to submit to the IRS, along with a Form 1096, on paper however, as you wont be able to e-file it.   Note that the landlord refused to provide an EIN by typing "refused" in the recipient's TIN box on the form 1099-Misc.
