My selling agent filed a 1099 s

My question is I used Purplebricks to sell my home. Long story short they never sent me a 1099s. This was my primary residence and the net gain was less than 250k and I am married filing separately head of household, long story.  They claim that they sent me one and it was undeliverable and that they sent me one via a secure message that went to my spam email and by the time I opened it the message was expired and thus I could not access it. I reached out to the company and they are no longer in the USA and only in the UK and Canada. They are giving me the the runaround and finally I got an email from them stating that all their USA records have been destroyed which makes totally no sense as i sold my property in April of 2019. I do have all the closing docs and my question is if i fill out a 1099 s and it does not match the 1099s that the seller agent filed will that trigger an audit because I have no way to see what the company submitted to the IRS. This was my first home sale and shame on me for being naïve for which tax docs that I needed.

    Complete the sale information using the closing documents. The gain may qualify for an exemption anyway. 

     

    A seller who has owned and used a home as a principal residence for at least 2 of the last 5 years before the sale can exclude from income up to $250,000 of gain ($500,000 for joint filers). TurboTax will help you determine your exclusion.

     

    To enter, follow these steps:

    • Under the Federal menu, choose Wages & Income
    • Expand the menu for Less Common Income
    • Click Start/Revisit next to Sale of Home (gain or loss)
    • Enter the information on the screens that follow
