My son is going through a divorce and on his 2018 return he is filing as Married/Separate. How does he handle the Federal Tax refund from his 2017 return?

    He can split it anyway he and his spouse agree to.

    Sorry I was not clear enough.  If on the 2017 return they filed Married/Joint and received a STATE tax refund what should he do about that amount as 2018 Income (sorry I said Federal Tax refund)? Should they each take half of that 2017 State Tax Refund as 2018 income?

    Do they live in a community property state?  Did they itemize their return for 2017?

    They do not live in a community property state.  They did itemize in 2017.
