My son married in July 2017, he separated in September and divorce papers have been filed. Does he have to file joint? They only lived together 8 weeks

Status is determined by what he was on December 31st.
So from above it appears he is still married, so he would need to file as Married Filing Separate or Married Filing Joint.
Best thing is do, if possible is work it out, sometimes the courts will help this process.
