You must file your income tax return for 2018 by mail, claiming your son as a dependent if he meets the qualifications as your dependent.  The IRS will make a determination as to who rightfully can claim him as a dependent.

You can also follow the IRS procedures for reporting a fraudulent return.

Did he live in her home all of 2018?  If he did and she supported him then she might qualify to claim him.

How old is (was he at the end of 2018) the son?   Did he live with you more than half of 2018?

Did you file a 2018 tax return?

Are you asking if you can amend 2018 now to claim him?
