My spouse and I have been married since 2019. He recently received his U.S permanent residency and social security number. My taxes are already filed as married, filed separately...

Oops, my question didn’t completely show.

My husband has never worked in the U.S, but is now a permanent resident and has a social security number. Is he eligible for the third stimulus even if I already filed my taxes?

I had to mail in my taxes because he didn’t have a SSN at the time, so I had to put he was a NRA.

Amend your tax return to file jointly as soon as possible, but before April 15th. The IRS page for Nonresident Alien Spouse is a good resource.

 

Make sure to include all worldwide income on your joint return. And you can now add the social security number (SSN) to the return.  Generally, if you are a U.S. citizen or U.S. resident alien, you are eligible for the full amount of the third Economic Impact Payment if you (and your spouse if filing a joint return) are not a dependent of another taxpayer and have a valid Social Security number (see exception when married filing jointly) and your adjusted gross income (AGI) on their tax return does not exceed:

  • $150,000 if married and filing a joint return or if filing as a qualifying widow or widower
  • $112,500 if filing as head of household or
  • $75,000 for eligible individuals using any other filing statuses, such as single filers and married people filing separate returns.
