the irs transcripts even show he did not file those years because he was incarcerated.

What was the rejection code or rejection message?   How did you file last year?  Did you file a joint return?   If so, the 2022 AGI would be the same amount for each of you, even if he earned nothing.  It is on line 11 of the joint return for 2022.   Or was it rejected for some other reason?

the Code IND-032-04 . it is for my spouse's AGI from last year. he was incarcerated for a couple years and we didn't get married until july 2023. so its my first time to file with him. i am unsure on how to fix it without paying for max or file married but separately. thank you for your response

Okay----then his 2022 AGI is zero.   If using zero for him will not work and let you e-file then you will need to print, sign and date the joint return  (BOTH of you sign it) , and mail it in.

When you mail a tax return, you need to attach any documents showing tax withheld, such as your W-2’s or any 1099’s.  Use a mailing service that will track it, such as UPS or certified mail so you will know the IRS/state received the return.

Federal and state returns must be in separate envelopes and they are mailed to different addresses.  Read the mailing instructions that print with your tax return carefully so you mail them to the right addresses.
