My wife passed a day after we were married in the hospital. she had a terminal illness. Courthouse wouldn't let us have a certificate unless she's there. Does that count?

Do I have to have a marriage certificate? or can we get married in the eyes of God?

To be legally married the marriage license must be signed by the couple, one or more witnesses, and the officiant conducting the ceremony. The officiant must take the signed marriage license to the appropriate court office to have it filed.

Marriage is governed by state law.  For you to be married for the purpose of filing a tax return, you must meet the requirements to be considered married in your state.
