Question

New York State Non-Resident Return

I live in New Jersey.  I only worked in New Jersey for the entire year of 2021.

My W-2 employer has a New York Mailing address only.  No office location in

New York.  They only withheld New Jersey taxes from my pay and stated that

all my wages are New Jersey.  Do I need to file a New York Non-Resident Form

IT-203 because my employer has a New York mailing address?  Thanks.

No, you do not need to file a New York (NY) nonresident return. The physical location of your employer does matter if it were physically located in NY. Because you do not have what is considered NY source income, and there is no NY withholding, then there is no need or requirement to file a NY return. A link below will show the requirements for filing a NY nonresident return.
