Newly Married - Living in Different States

My husband and I got married in December of 2023 in Georgia.

 

I live, work and own a home in Georgia. He lives, works, and owns a home in South Carolina.

 

Should we file jointly or separately? Does the tax laws in South Carolina and Georgia allow for this? What should we be aware of while considering our options?

You will almost always pay more in federal tax if you file separately.  Therefore, unless you have a  compelling reason to file separately you should probably file jointly.  Georgia allows you to file separately if you file joint for federal, but only if your spouse did not live or work in Georgia.  South Carolina requires you to use the same status that you use for federal.  If you file a joint federal return, you must file a joint SC1040 with the Schedule NR. Your husband will report all income for the entire year to South Carolina. You will only report income earned in South Carolina.

 

You might want to consider using TurboTax Desktop software.  You can create as many returns as you want in Desktop.  You can prepare a joint, save with a different name and convert it to separate returns, etc.  For information on TurboTax Desktop go to TurboTax Desktop Software
