I was separated from my husband 2024 and 2023 but not legally and have kids... do I file head of house

    It depends. Did you live in the same household at all after June 30th, 2024? If not, and your kids live with you and are qualifying children and you pay more than half of the cost to maintain the home, then yes, you can file as head of household.

     

    If your husband lived with you at all during the last 6 months of 2024, then you cannot file as head of household.

    If you lived apart from your spouse for at least the last six months of 2024 and you have the children then you can file as Head of Household.

    If you qualify as Head of Household, when you enter your marital status (single or married filing separately) into MY INFO, and then enter your qualifying dependent, TurboTax will offer HOH as your filing status.
