Ok i just filed ..and i thought my husband was gone file oir newborn but he cant..its to late for me to add him or what

Are you and your husband filing separately? Why?  What happened when your husband tried to claim the child as a dependent?

Yes we filing separately.. He just got his w2s and found out they wasn't taking any federal tax out

he still has to file, especially since no taxes were withheld.  no taxes have been paid in on his earnings, he needs to file the return to see if he owes money.

It's still not clear if you or he already filed.  Did you file a separate return, and was it accepted?  Did your spouse file a separate return, and was it accepted or rejected?

Why aren’t you filing a Joint return?  Joint is usually the best way to file.  And there are several credits you can't take when filing separately, like the EITC Earned Income Tax Credit, Child Care Credit and Educational Deductions and Credits.  See …….

Yes we file separate ..he has not filed yet he just got his w2s today..I already filed on the 28 th

If you want to claim your baby you need to wait for your return to fully process and you get the refund.  Then you can mail in an Amended 1040X return.  How to amend an Online return

First of all, just because your husband will owe taxes (because of no withholding) doesn't mean he "can't" claim his child as a dependent.  He certainly can, if that's what you want to do.

Second, you will probably pay lower taxes overall if you file jointly, especially if you have a child.  Many deductions and credits are limited or disallowed for married filing separately.  If you wanted to file jointly, then you do nothing now.  Wait for your original tax return to be processed and your refund paid.  Then, file an amended return to change to married filing jointly, and add your child and your spouse's income and deductions.

Finally, if you still want to file separately, then your spouse can file a separate return at any time.  You will need to wait for your original refund to be paid, then you can file an amended return, keeping as married filing separately, but adding your child.

In all cases, the amending software won't be ready until some time in March.
