File your tax return with the children as your dependents.  You will only be able to print and mail the tax return if another return with their names and SS numbers has already been received by the IRS.  The IRS will pay any tax refund shown on the tax return.  The IRS will contact both parties in the future to investigate who should have claimed the children as dependents.  The loser of the investigation gets to re-pay any tax refund due to the improper claiming plus penalties and interest.
