Partner & I live together, & have a child. Not legally married/filing separate. My partner is claiming our child. Can we both file HOH? We equally pay for all expenses.

No.   If you all live together as a family then only one of you can claim that child.   In order to file HOH you must have a blood-related dependent--just paying half the expenses does not make you HOH.   One of you can claim the child and get the child-related credits, and the other just files Single.

If you are both living in the same household, only one of you can have Head of Household filing status and that would be the one who is claiming the child and who has provided over one-half the cost to maintain the home.

 

One of you paid at least $1 more than the other to maintain the home.
