I have a question that I am hoping that someone can help me with (after spending 3 hours on the phone with the IRS they have advised me that they do not have a answer for my question).

 

My mother had been receiving a monthly lifetime spousal benefit payment from my dad's employer after he passed away.  She had been getting the payments since 2013 and each year received a 1099-R in her personal name.  However, my mother also passed away in 2021, and this year the 1099-R was issued in the name of her estate versus her personal name.  She received payments from January 2021 until August 2021 (all before she passed at the end of August 2021).

 

I need clarification on where to process this 1099-R?  Is it filed under her personal taxes as it has always been (and what I would assume is correct) or does it need to be filed under estate taxes since the 1099-R was issued to her estate?

 

Thank you in advance for any insight or assistance I can get on this.

The easiest way to resolve the issue is to have the company issue a corrected 1099-R. They should understand that the income received prior to death was her personal income and belongs on her 1040.

 

Another route is to nominee the correct portion of the 1099-R to her personally from the estate. Please see this LINK for instructions.
