I live in Texas.  If my mortgage company paid my property tax for 2024 in January 2025, instead of December 2024 as they have in previous years, can I include the property tax amount paid on January 15, 2025 as reflected on my mortgage statement in my year 2024 income tax filings? 

 

Apparently, Texas changed the law to have mortgage company escrow accounts pay property tax in January instead of December now.

    Confirm what the 1098 (Mortgage Statement) says.

    Yes, I understand. the concern is that my 1098 reflects $0 real estate taxes paid.  And it appears due to the new Texas guidance, the mortgage company can pay the real estate taxes in prior to the deadline in January 2025, which they did pay on 15 January 2025.   The question is, can I include the real estate taxes paid in January 2025 (since they are real estate taxes paid for the 2024 calendar year (January - December 2024)?   Is there any IRS guidance that addresses this situation?  Please let me know and thanks for your assistance in advance.

    No.  Since the taxes were paid in 2025, you can take the deduction in 2025.  They are deductible when the lender paid.  See: IRS Publication 530
