Hi all,

I am doing my masters that I started last August and at the same time I am teaching (I was granted with a teaching fellowship). I came from Spain on a F1 visa and it is my first time filling taxes. The University pay the full tuition and I receive a stipend of $16000 per academic year for my job as a teacher.

The University is in Washington DC but I am living in Virginia.

Being said this, two questions:

1) I filled out the form 8233 with my employer since I am a citizen from Spain. Is this the only form I need to fill out in the HR office?

2) Do I need to fill for federal taxes only? Or also for Estate taxes, in this case, Virginia?

I want to use Turbotax to do my taxes. Can you help me through it? I am really lost and I want to avoid mistakes.

Thank you!

If you have not stayed in the United States for more than five years, you are considered a nonresident.  You are required to file a Form 1040-NR.  As TurboTax does not support any nonresident tax forms, you are advised to contact Sprintax which is affiliated with TurboTax to help our nonresident customers with their US tax returns.

For your information, since you work in Washington DC and live in Virginia, these two states are considered the reciprocal states.  I am not sure how your Form W-2 is reported.  However, the reciprocal rules are as follows:

As a worker in a reciprocal state ( DC), you can fill out that state's exemption form D-4A and give it to your employer if you don't want them to withhold taxes for your work state ( DC). If you do this, make sure your employer also withholds taxes for your resident state (VA), otherwise, you may get hit with underpayment penalties come tax time.  You do not need to file a DC return.  If you and your employer have done all that, you only need to file the DC return.  If not, keep that in mind for next year.

When you go through Sprintax, see the attached link above, they should provide you with all the instructions to complete both of your federal and state filings.  Make sure to verify the rules for F-1 visa holders with the states, they might not be the same as the US residents'.  To reach your states, click here for States.
