Question

Turbotax has added California form 540NR to my return even though I never mentioned california at any point. Why has it done this and how can I remove it? I live overseas

My understanding is that if I have not resided in any state during the year then I don't need to file any state return, not even non-resident forms like 540NR.

Did you live in California prior to moving overseas? Do you have any tax forms that are sourcing income to California?

 

If you have no filing requirement for California, you can delete the return.

There seems to be no option to delete the state return - I don't even think it is a state return, it's just a single form (540NR). Under the state taxes section on turbotax it shows no state, it's totally empty. Same under Personal Profile>Other state income, it says None apply. The 540NR form only shows up when I try to file, when I preview the return. I can't see any option to remove it.

Form 540NR is a nonresident California state return.

 

You might check your W-2s or any other information returns (e.g., 1099s) to see if they have entries in the state section indicating California-sourced income or withholding.

 

If there is no California-sourced income or withholding, no deductions or credits or additional taxes, then you could just choose not to e-file the return when you are in the File section.

 

As a nonresident, you pay tax on your taxable income from California sources. See this California webpage for more information.

Sourced income includes, but is not limited to:

  • Services performed in California
  • Rent from real property located in California
  • The sale or transfer of real California property
  • Income from a California business, trade or profession
