What filing status should I use if my spouse and I live in different states?

    If you live in Texas and your spouse lives in New York and you are filing jointly on your 1040, you have two options per the NYS Department of Taxation and Finance. You can either:

    1. file separate New York State returns, or
    2. file jointly, as if you both were New York State residents

    If you file separate returns, you would have to file a IT-203 and your spouse would file a IT-201. Furthermore, if you choose to file joint federal returns and separate state returns, then it is best to use TurboTax Desktop.
