When filing Married Filing Separately if one spouse makes no income, does the no income spouse need to still file

My husband and I file as "married filing separately." In 2022, I had zero income. Do I need to file since my husband is still filing as married filing separately. No one else can claim either of us and we do not live in a community property state (Alabama). And if I don't need to file, no one else can claim me as a dependent, and I had zero income, can my husband claim me as a dependent?

    No, if you have no income, you are not required to file.   Just an FYI, there is a form you can file to protect you from your spouse's debts or other offsets so that you can still maximize your tax position.

    Why aren't you filing a Joint return?  He will get a higher Standard Deduction.  A spouse is never a dependent.  You just file Joint even if one spouse had no income.  It's better than filing MFS and claim a dependent.

     

    And there are several credits you can't take when filing separately, like the

    EITC Earned Income Tax Credit

    Child Care Credit

    Educational Deductions and Credits

     

    And contributions to IRA and ROTH IRA are limited when you file MFS.

    There are reasons why we need to file separately that make more financial sense than filing jointly that I don't want to get into. I just wasn't sure if I needed to file since I had no income.

    1. If you have no taxable income, you are not required to file a return.

    2. No, your husband can NOT claim you as a dependent since you are his wife. Here is why you do not want him to claim you:

    • If you file MFJ, the standard deduction is $24,800 
    • If he files MFS the standard deduction is $12,950 and if he could claim you, you are worth $500 as a dependent.
    • The IRS does not allow one spouse to claim another.

     

    The math makes much more sense as MFJ unless you are not filing with him for other reasons.
