When receiving a nonwages payment from an ex employer from settlement do I need a 1099? Or do I even put it on my taxes for nonwages.

No, you do not need a 1099 to report the settlement on your tax return. Generally speaking, most settlements are taxable unless they are for physical injuries.

 

The IRS codes actually state that lawsuit proceeds are taxable unless there is a specific exception based on the facts and circumstances. Please see the section under Analysis that includes information about what is taxable including nonwage settlements from an employer.

The income is reported as Other Income. 

To enter Other Income, please follow the steps below:

  • Open your return.
  • Click on Income & Expenses.
  • Scroll to the bottom under Less Common Income select Start (or Update) for Miscellaneous Income.
  • Choose Other reportable income at the bottom of the list and start
