Question

Who is the "legal" parent of a step child? One birth parent is dead. How can you get consent from the ***** parent?

TurboTax asks for legal parents.  My wife is and her previous husband died before I met her.  Next question is do you have consent from the other parent.  Do I ?  if that parent is dead?

If you are the step-dad then you are a "legal" parent for tax purposes.

 

Refer to the answer by Super Champ @Opus 17 in My husband did not have earned income in 2017. He is also not the legal parent of my 2 children (step-father). Can I not still get child care credit?
