You and the child’s other parent aren’t married but live together. How do I figure out who claims child for the whole year?

Most of the time, couples agree on who will claim the child but if you can't come to an agreement you can use the IRS Tiebreaker rules as a guide to decide who should claim your child.  Since you are both the parents then you would decide by the following:

 

  • The parent with whom the child lived the longest during the tax year, if you both lived the same amount of time then,
  • The parent with the highest AGI

And....if you are all living together as a family, the child's SSN can only be used on ONE of your tax returns---there is no sharing of the child-related credits between the two of you.   One of you files Single and does not enter anything about  the child on their return; the other parent claims the child and enters the child as a dependent.
